Le président afghan, Hamid Karzaï, a accepté, jeudi, de libérer une jeune Afghane
qui purgeait une peine de 12 ans de prison
pour avoir eu une relation sexuelle hors du mariage,
après avoir été violée par un proche.
Le bureau de M. Karzaï a déclaré dans un communiqué que la jeune femme et son agresseur avaient accepté de se marier.
Il s'agit donc d'un revirement pour la jeune femme de 19 ans, qui avait précédemment refusé l'offre d'un juge qui lui proposait d'être libérée si elle épousait son violeur.
Son cas a été médiatisé dans un documentaire, dont la diffusion a été interdite dans l'Union européenne par crainte que les femmes qui y figurent ne soient mises en danger si le film était diffusé.
Plus de 5000 personnes ont récemment signé une pétition demandant au président Karzaï de libérer la jeune femme.
En prison, elle a accouché d'une fille conçue lors du viol
et elle l'élève derrière les barreaux,
une pratique courante chez les femmes emprisonnées en Afghanistan.
Le communiqué du bureau du président ne précise pas quand la jeune femme sera libérée.
Lors d'une entrevue avec l'Associated Press le mois dernier, la jeune femme avait dit espérer que l'attention suscitée par le film puisse l'aider à être libérée.
Mais après l'interdiction du film, elle a dit perdre espoir et a indiqué qu'elle envisageait d'épouser son violeur pour pouvoir être libérée.
Elle a précisé que son agresseur avait fait des pressions pour qu'elle cesse d'accorder des entrevues.
Environ la moitié des 300 à 400 femmes détenues en Afghanistan sont emprisonnées pour des « crimes moraux »,
comme les relations sexuelles hors du mariage
ou l'abandon du foyer conjugal,
selon des rapports des Nations unies et de différentes organisations de recherche.
[J’imagine qu’un article suivant parlerait des «crimes d’honneur» (mais c’est trop de sujet (d’angles) pour un seul article. Le nombre de femmes lapidées, égorgées, défigurées (on peut simplement leur couper le nez et les oreilles. Ou leur jeter de l’acide au visage. Et ça se passe dans bien d’autres pays. Même en Inde supposée être une démocratie. Remarquez que là-bas on n’incite plus les épouses et veuves à se jeter dans le bûcher funéraire de leur défunt mari afin que les héritiers (fils) puissent profiter pleinement de leur héritage. Ici, au Canada, une étudiante en médecine qui allait dans son pays d’origine a eu les yeux crevés par son époux pour avoir trop étudié sur son ordi. Et ici, encore, une famille Afghane, le père, la mère et l’enfant Jésus (je veux dire, le fils.) ont assommé les 3 filles/sœurs et l’ex-femme du mari pour ensuite pousser l’auto où elles étaient prisonnières à l’eau où elles se sont noyées. Le procès est en cours. On les avait attrapé juste au moment où ils allaient prendre l'avion pour retourner chez-eux. Il est intéressant de voir que l’honneur d’un homme tient à la virginité d’une femme (fille/soeur/cousine/nièce/voisine) et que cet «honneur» (chose délicate et fragile) s’épanouit en assassinant (tuant) 4 femmes sans défense. Les sous-hommes et les primitifs pensent trop. (On remarquera qu'il fut une époque où le chevalier trouvait honorable de défendre une femme sans défense ou de combattre pour elle et ne voyait aucun inconvénient à mourir ce-faisant. On voit donc que cette notion a quelque peu évolué dans certains pays où elle semble avoir été incomprise. Sans doute une traduction incomplète des documents originaux. ]

An Afghan woman imprisoned for adultery after a relative raped her can go home or remain in detention for her safety [?], President Hamid Karzai said Thursday.
Karzai said he was concerned that if the woman returned to her village after her release, she could face reprisals from the conservative society, CNN reported Thursday.

did not immediately report the rape by her husband's cousin over fear of reprisals

and was later sentenced to 12 years in prison for adultery because her attacker was married.
Her sentence was subsequently reduced to three years.
The country's justice minister will meet with the woman and her rapist to determine whether she wants to marry him and legitimize her daughter, Karzai said.

"If Gulnaz tells the justice minister today that she would marry the man and wouldn't have any problem after release or if she presents any other way that she could live without any risk to her life and her daughter's, then the Justice Ministry will issue a statement today announcing her release,"
a spokesman for Karzai said.
The woman is raising her daughter in jail and had previously agreed to marry her attacker in order to be released,
but an attorney for Gulnaz now says she does not wish to marry her rapist and has a safe place to go on release.

An Afghan rape victim who was jailed for adultery does not have to marry her attacker to be freed, her lawyer has told the BBC.
Lawyer Kimberly Motley says this was clarified personally to her by President Hamid Karzai's office.
Mr Karzai pardoned the woman, named as Gulnaz, earlier this week, but some reports had said this was on condition that she married her attacker.
Gulnaz gave birth in jail to a daughter who has been kept with her.
On Friday, Ms Kimberly said that 21-year-old Gulnaz would be released with no pre-conditions and would then be free to marry whomever she chooses.
"She doesn't have plans for the future, she just wants to get out (of prison),"
the lawyer said.
She added that Gulnaz had a "safe place" to go after her expected release.
The case has drawn international attention to the plight of many Afghan women 10 years after the overthrow of the Taliban.
Human rights groups say hundreds of women in Afghan jails are victims of rape or domestic violence.
Gulnaz earlier said that after she was raped in 2009 she was charged with adultery.
"At first my sentence was two years,"
she said.
"When I appealed it became 12 years. I didn't do anything. Why should I be sentenced for so long?"
The most recent appeal saw her sentence reduced to three years before the presidential pardoning.

Some 5,000 people signed a petition for Gulnaz's release.

The attack on Gulnaz was brought to light by her pregnancy.
Her attacker - her cousin's husband - was jailed for 12 years, later reduced on appeal to seven.
Her story was included in a European Union documentary on Afghan women jailed for so-called "moral crimes" but the EU blocked its release because of "very real concerns for the safety of the women portrayed".
The EU's Ambassador and Special Representative to Afghanistan, Vygaudas Usackas, said on Thursday he was "delighted" to hear Gulnaz was to be freed.
"Her case has served to highlight the plight of Afghan women, who 10 years after the overthrow of the Taliban regime often continue to suffer in unimaginable conditions, deprived of even the most basic human rights,"
he said.
"While we applaud the release of Gulnaz, on the orders of President Karzai, it is the hope of the European Union that the same mercy that has been extended to Gulnaz is applied to all women in similar circumstances."
Human rights workers criticised the EU for withdrawing the documentary, saying the injustice in the Afghan judicial system should be exposed.
Half of Afghanistan's women prisoners are inmates for "zina" or moral crimes.
The BBC's Bilal Sarwary, in Kabul, says recent cases of violence against women are embarrassing for the Afghan government.
Many Afghan women's rights activists say there must be an end to the culture of impunity and police must punish all those behind violence against women, he adds.
